Aqueous Film-Forming Foams Products Liability Litigation
Aqueous Film-Forming Foam (AFFF) is a type of firefighting foam that has been commonly used to extinguish fires. AFFF Contained PFAS chemicals (or “forever chemicals”) which are synthetic compounds that fail to break down and remain in the environment and in humans indefinitely. Since the 1960s, manufacturers have used toxic PFAS chemicals in firefighting foam or AFFF, putting firefighters and others at risk of several types of cancer and other serious illnesses. There have been over 37,000 claims consolidated in the AFFF MDL (multidistrict litigation) in the Distrct of South Carolina as of September 2025. MDLs help streamline the lawsuit process and, unlike class actions, allow victims to retain their individual claims and receive compensation that reflects their individual damages. While the initial AFFF MDL bellwether trial that would place individual personal injury cases forward to test the viability of claims has been postponed without date, we believe that there will continue to be negotiations for global settlements.
